The EU Plans to Reign In the Gig Economy
10/12/2021TechCrunch’s Natasha Lomas writes an incisive analysis of proposed EU legislation for the gig economy, which it hopes will improve conditions for platform workers across the block, including by establishing a framework to tackle the problem of bogus self-employment. The Commission’s overarching goal, according to the article, is to create a level playing field between traditional businesses and gig platforms, as well as between different gig platforms (or “digital labor platforms” as its draft text calls them) — by enforcing minimum standards for platform businesses. In our view the five-point criteria laid out still leave substantial room for classification of subcontractors as true independents, but the proposals are a big step toward drawing sharper lines between independent contractors and de facto employees – an area which is highly fact-driven and which our Labor Law Plus team analyze regularly for companies worldwide – and which could lead to framing issues more concisely in disputes both for platform and non-platform work.
