Italy Update: Improper use and for personal purposes of company materials legitimizes dismissal
09/01/2023Court of Cassation, labour section, 1 December 2022, n. 35399
The use of company equipment for own use during working hours constitutes just cause for dismissal.
According to the Court of Cassation, the economic entity of the asset and the damage caused to the company is irrelevant, which can also be of modest value given that what matters is that with this conduct the worker fails in his fundamental duty to keep his energies available to the employer and not to use company material for his own interests.
