Italy Update: Procurement of logistics services: responsibility is always joint and several

Ministry of Labour and Social Policies – Reply to 17 October 2022, no. 1

The Ministry of Labour, in reply to question no. 1 of 17 October 2022, offered clarifications regarding the application of the principles envisaged for the protection of workers in contracts and, in particular, the application of the solidarity regime referred to in Article 29, paragraph 2, of Legislative Decree 276/2003, in the event of a contract for the provision of several services governed by Article 1677-bis, of the Italian Civil Code, on logistics, recently amended by Article 37-bis, Legislative Decree 36/2022.

The Ministry specifies that in the case of contracts for several logistics services relating to the activities of reception, transformation, storage, custody, shipment, transfer, and distribution of goods, Article 29, paragraph 2, Legislative Decree 276/2003 must continue to apply, without the provision contained in Article 1677-bis, of the Italian Civil Code, can make this general form of protection for these categories of contracts disappear.
