Italy Update: Repealed the Patent box, in its place the super deduction
04/11/2021Legislative Decree no. 146 of 21 October 2021 (so-called “fiscal” DL) came into force, bringing with it the repeal of the “old” Patent box regime and the introduction of the new option for the “super deduction” of 90% of research and development costs on certain intangible assets:
- Copyrighted software
- Industrial patents
- Trademarks
- Designs
- Processes, formulas and information relating to experience acquired in the industrial, commercial or scientific field that can be legally protected.
The scheme is optional, is valid for 5 years and is irrevocable and renewable (the methods of exercising the option will be identified with a specific provision of the director of the Revenue Agency).
