Italy Update: Transposition of the Whistleblowing Directive

The Council of Ministers has definitively approved d.lgs. No 10 of 2023 March 24 on the implementation of Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons reporting on breaches of Union law and laying down provisions concerning the protection of persons reporting on breaches of national law‘.
The provisions of the Decree will take effect from 15 July 2023.
It should be noted that for private sector entities that have employed, in the last year, an average of employees, with permanent or fixed-term employment contracts, up to 249, the obligation to establish the internal reporting channel pursuant to the decree takes effect from 17 December 2023.
