Italy Update: Video camera footage can be used for the purposes of a disciplinary dispute even if installed for different purposes such as security protection

Court of Cassation, 23 March 2023, n. 8375

For the purposes of a disciplinary dispute, the footage of the video surveillance systems installed for security reasons and oriented towards spaces accessible also to non-employees can be used.

According to the Court of Cassation, these shots, even if intended for other purposes, such as the protection of safety, are, therefore, usable as they comply with the procedural guarantees provided for by art. 4, second paragraph, Law 300/1970.
