Mexico Update: EXTENSION OF ENTRY INTO FORCE ON OUTSOURCING REFORM

In follow-up to the Reform on Outsourcing, I inform you that last Saturday, July 31, 2021 was published in the Official Journal of the Federation the Decree by which an extension is granted to the deadlines for entry into force of the aforementioned Reform in The Matter of Subcontracting of personnel until next September 1 of this year.

Therefore, it is established on September 1, 2021 for the entry into force of the following actions:

  • Possibility of applying for registration with the Ministry of Labour and Social Security for natural or legal persons providing specialized services.
  • Reforms in tax matters regarding effects on deductibility, accreditation and criminal responsibility.
  • Transfer of employees under an employer substitution without the transfer of assets.
  • Cancellation of the different employer registers that have been requested by class.
  • Provide information to the Mexican Social Security Institute related to the contracts concluded by natural or legal persons who provide specialized services.
