US Update: Premium Processing Upgrades for Pending EB-1 Multinational Manager and EB-2 National Interest Waiver I-140 Petitions to Begin in June and July

Brief Overview

  • Beginning June 1, USCIS will accept Form I-907 Premium Processing upgrade requests for pending EB-1 Multinational Manager Form I-140 petitions that were filed on or before January 1, 2021.
  • Beginning July 1, USCIS will accept Form I-907 Premium Processing upgrade requests for pending EB-1 Multinational Manager Form I-140 petitions that were filed on or before March 1, 2021, and pending EB-2 National Interest Waiver (NIW) I-140 petitions that were filed on or before June 1, 2021.
  • The premium processing fee will be $2,500 for affected case types. The processing timeframe will be 45 days, measured from the date USCIS receives all prerequisites for adjudicating the case.
  • At this time, USCIS will not allow petitioners to request premium processing of these cases at the time of petition filing.

U.S. Citizenship and Immigration Services (USCIS) has announced that premium processing will become available for certain pending Forms I-140, Immigrant Petition for Alien Workers, in the EB-1 Multinational Manager and EB-2 National Interest Waiver (NIW) categories, beginning in June and July, respectively. Petitioners who wish to request a premium processing upgrade must file Form I-907, Request for Premium Processing Services, on or after the applicable effective date.

This initiative is part of USCIS’s previously announced incremental expansion of premium processing to certain additional form types over a period of at least three years. This phased-in expansion is also likely to impose conditions or limitations on the availability of premium processing for new case types to which premium processing is extended. 

This initial expansion of premium processing will occur in two phases:

Beginning June 1, 2022, USCIS will accept Form I-907 premium processing upgrade requests for pending EB-1 Multinational Manager petitions that were filed on or before January 1, 2021.

Beginning July 1, 2022, USCIS will accept Form I-907 premium processing upgrade requests for:

Pending EB-1 Multinational Manager petitions that were filed on or before March 1, 2021; and

Pending EB-2 NIW petitions that were filed on or before June 1, 2021.

USCIS will reject premium processing requests received before the applicable June 1, 2022, or July 1, 2022 start date. At this time, USCIS will not allow petitioners to request premium processing of these cases at the time of petition filing.

At the time of implementation, the premium processing filing fee for these two categories of cases will be $2,500. USCIS is authorized to adjust premium processing fees on a biannual basis, based on changes in the Consumer Price Index for all Urban Consumers (CPI-U).
